Evolve Resale Terms of Service

Welcome to Evolve Resale. These Terms of Service ("Terms") explain the rules for using the Evolve Resale website and services (the "Platform"). By creating an account, listing an item, or buying an item, you agree to these Terms. If you do not agree, please do not use the Platform.

1. What Evolve Resale Is

Evolve Resale is an online marketplace where people buy and sell secondhand items directly with each other. Evolve Resale provides the tools to list, discover, message, pay and ship, but we are not the seller or buyer of any item. Each sale is a contract between the buyer and the seller.

2. Your Account

You must be at least 18 years old, or the age of majority where you live, to use the Platform. You agree to give accurate information, keep your login details private, and keep your account up to date. You are responsible for everything that happens under your account. One person may not run multiple accounts to get around a suspension or limit.

3. Listing Items

When you list an item, you confirm that you own it and have the right to sell it, that your photos are your own, and that your title, description, size, brand, condition, price and package details are accurate and honest. You must disclose any defects. Listings must stay up to date — mark or remove items that are no longer available.

4. Prohibited Items and Conduct

You may not list or sell counterfeit or replica goods, stolen property, weapons, drugs, alcohol, tobacco or vaping products, recalled or unsafe items, adult content, live animals, hazardous materials, or anything illegal where you or the buyer live. You may not harass other users, post misleading or offensive content, manipulate reviews, spam, or ask other users to pay or communicate outside the Platform to avoid its protections. We may remove content or listings that break these rules.

5. Buying Items

When you buy an item, you agree to pay the listed price plus any buyer fees, shipping and applicable taxes shown at checkout before you confirm. Prices are set by sellers. Please read the listing carefully and message the seller with any questions before buying.

6. Payments

Payments are processed by a third-party payment provider. Evolve Resale does not store full card details. Until live payments are enabled, checkout runs in a clearly labeled sandbox mode and no real money is charged or paid out. Once live, buyer payments are held until the order is completed, then released to the seller's balance, minus any applicable fees.

7. Fees

Any fees charged to buyers or sellers will be shown clearly before you confirm a purchase or listing. We may change our fees with advance notice on the Platform. Changes do not apply to orders already placed.

8. Shipping

Sellers must ship items within the shipping deadline shown on the order, using the label or method provided through the Platform, and pack items securely. Shipping rates and tracking are provided by third-party carriers and shipping services. Buyers must provide an accurate delivery address. Evolve Resale is not responsible for carrier delays, but we will help resolve problems through the order and dispute process.

9. Buyer Protection and Disputes

After delivery, the buyer has a limited protection period, shown on the order, to confirm everything is fine or to report a problem — for example, an item that never arrived, arrived damaged, or is significantly different from its description. If no problem is reported in that time, the order is completed automatically. When a dispute is opened, both parties may be asked for photos or other evidence. Evolve Resale may review the evidence and decide the outcome, which may include a return, refund, or release of payment to the seller. Protection only applies to purchases paid for through the Platform.

10. Returns

Because items are sold by individuals, sellers are not required to accept returns for change of mind unless they choose to. Returns approved through a dispute must be sent back as instructed, in the same condition the item arrived.

11. Seller Balances and Payouts

Completed sales are added to the seller's balance. To withdraw funds, sellers may need to verify their identity and add payout details with our payment provider. We may delay or withhold payouts linked to disputes, suspected fraud, or violations of these Terms.

12. Reviews

After an order is completed, buyers and sellers may leave a review. Reviews must be honest and based on a real transaction. We may remove reviews that are abusive, fake, or unrelated to the transaction.

13. Reporting and Moderation

You can report listings or users that you think break these Terms. Our team may review reports, remove content, restrict features, or suspend or close accounts. Where reasonable, we will tell you why action was taken.

14. Your Content

You keep ownership of the photos and text you post. By posting them, you give Evolve Resale a non-exclusive, royalty-free license to display, store and promote that content on and in connection with the Platform while your listing or account is active. You confirm you have the rights to anything you upload.

15. Our Content and Brand

The Evolve Resale name, logo, design and software belong to Evolve Resale. You may not copy, reuse or imitate them without written permission.

16. Taxes

You are responsible for any taxes that apply to your sales or purchases. Where required by law, we may collect sales tax at checkout or report seller earnings to tax authorities.

17. Privacy

We collect and use personal information to run the Platform, process orders, ship items, keep users safe and meet legal obligations. We share delivery details with sellers and shipping providers only as needed to complete an order. We do not sell your personal information.

18. Ending Your Account

You can close your account at any time once you have no open orders or disputes. We may suspend or close accounts that break these Terms, put other users at risk, or are involved in fraud.

19. Disclaimers

The Platform is provided "as is". We do not guarantee the quality, safety, legality or authenticity of items listed by users, or that the Platform will always be available or error-free.

20. Limitation of Liability

To the extent allowed by law, Evolve Resale is not liable for indirect or consequential losses, or for disputes between buyers and sellers beyond the protections described in these Terms. Our total liability for any claim is limited to the fees you paid to us in the 12 months before the claim. Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived.

21. Changes to These Terms

We may update these Terms from time to time. We will post the new version on this page and update the date at the top. If changes are significant, we will notify you. Continuing to use the Platform after changes means you accept them.

22. Governing Law

These Terms are governed by the laws of the State of Wisconsin, United States, without regard to conflict of law rules, unless the law where you live requires otherwise. Any dispute arising out of these Terms that is not resolved through our dispute process will be handled in the state or federal courts located in Wisconsin, and you agree to those courts for that purpose. Nothing in this section removes rights you have under consumer protection laws in your own country or state that cannot be waived.
